Car dealer Ed Bozarth offered to transfer Tim Wilk, 38, an automotive technician, to one of his dealerships. The Wilks picked Topeka because they said they believe the community offers a better lifestyle for less money. This spring, they bought a three-bedroom, two-bath house at 2631 S.E. 32nd for $119,500. The house has nearly 1,800 square feet; a two-car garage; and a big yard for their son, three dogs and a cat.
Prosperity in the U.S. construction industry was again on the house, as the residential segment continues to exhibit most of the recent growth in the domestic building industry. The construction industry appears to be hovering at a level close to last years pace, says Robert A. Murray, vice president of economic affairs for McGraw-Hill Construction. Housing remains very healthy, and the upturn for non-residential building in February was a welcome development after a sluggish January. Murray says that higher steel prices could be putting a crimp in the nonresidential segments. Over the course of 2004, its expected that nonresidential building will see a modest strengthening trend. Admittedly, though, this years sharp increase in steel prices has made the nonresidential upturn less certain, given the impact that higher costs and materials shortages may have on individual construction projects. At this juncture, it appears that the nonresidential upturn will be dampened but not derailed, assuming steel prices settle back by midyear, but the situation clearly bears watching.

The authors note that there have been 13 studies which used prospective randomized control designs which compared hypnosis either to baseline level noiception or to a control condition of some sort. These studies consistently demonstrate that hypnosis can assist patients with chronic pain with a reduction in their pain experience and pain related coping for a variety of chronic pain conditions. Hypnosis was generally found to be more effective than other nonpharmacological interventions such as physical therapy, attention, and psychoeducative strategies. The intervention which was most commonly employed was training in self-hypnosis. The authors provide a critique of these studies in that there appears to be a lack of standardization in the uses of hypnotic interventions in these clinical trials and also that the treatment group numbers tended to be lower than one might desire. The authors also provide a number of very useful suggestions for future research and clinical application of hypnosis to assisting patients with chronic pain syndromes. Lawyers view the area of personal injury to be a rich, unmined seam: just one in four people who have a legitimate claim for personal injury actually go to court, according to the Association of Personal Injury Lawyers. Furthermore, the introduction of no-win, no-fee for lawyers means you can take action without fear of facing a huge bill if you lose. Advertising and the legal profession have not always mixed so easily. Lawyers were only allowed to advertise on radio in 1984 and it is only since 1987 that they have been permitted to sell themselves on television. One company to promote itself on television is Nelsons Solicitors, based in Nottingham. They used their own clients to give anecdotal accounts of the firms work in personal injury, fraud, criminal law, wills, financial services and divorces. “Because of the extremely sensitive nature of divorce we used an actress to read a clients statement,” said marketing manager Christine Pudge. “We got a good return on some parts of the adverts. The trouble is you cant sell a legal firm like you can sell a bar of chocolate. People either need a lawyer or they dont. You cant make it irresistible.” Guidelines for lawyers who want to advertise are laid down by the Law Society. In what outsiders might view as a traditional piece of legalese, lawyers are allowed to advertise, but they cannot tout for business. “That means they can drop a leaflet through your door but they cant knock on your door or ring you up and try and sell you a product,” said Catherine Slater of the Law Society. “They must not do anything that brings the profession into disrepute or which is too tacky.” Legal firms are increasingly aggressive in the field of personal injury, according to Chris Fogarty, features editor of The Lawyer magazine. “One firm advertised their personal injury service on the back of hospital appointment cards,” he said. “The British are coy about going to court. But I saw one lawyer stand up last year at a meeting and say he was proud to be an ambulance chaser. Many see themselves as social crusaders.” However, Irwin Mitchell, a firm with offices in London, Birmingham, Leeds and Sheffield, decided not to broadcast a radio advert dealing with family law. “We produced a family law advert on divorce but the reaction was that it possibly crossed the line and we did not put in on air,” said marketing executive Stuart Peace. “We would never advocate advertising to the extent that is done in America. We must get the balance right. The key is not to be insensitive or in-your-face.” The firm has advertised on local radio in London, Sheffield and Leeds, with adverts ranging from 10 to 80 seconds. The longer messages included documentary-style accounts of a road accident victim and a mother whose child was hit by a car. In another broadcast, the comedian Alexei Sayle was hired to perform a tongue- in-cheek advert.

There are a number of procedures used to restore the function of the upper eyelid but the lower eyelid is often ignored. The problems of medial and lateral canthal ligament laxity lead to abnormalities of lacrimal function in addition to inadequate eyelid closure. This series reports the results of lower eyelid surgery in addition to the previously described techniques of upper eyelid reanimation. Lateral ligament tightening and medial canthoplasty in combination with gold weight implantation has been highly successful in managing difficult cases of corneal exposure. The most serious early immediate complication of facial paralysis is due to corneal exposure. The surgical management of the eye is often directed towards the upper lid but the lower lid contributes significantly to the problem of exposure keratitis and corneal ulceration. The procedure takes one to three hours. Dr. Jochen will make incisions that follow the eyelids natural lines, in the creases of the upper lids and just below the lashes in the lower lids. Through these incisions, he removes excess fat and trims any sagging skin and muscle. The incisions are closed with very fine sutures.

Monday May 5, 2003 will go down in history as a day to remember in employment law. It was the day the long-debated amendments to the Health Safety in Employment Act finally came into effect. Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

In the 1940s, the World Health Organization (WHO) defined health as a state of complete physical, mental, and social well-being and not merely the absence of disease or infirmity. At the first International Conference on Health Promotion in Ottawa, Canada (1986), the Ottawa Charter for Health Promotion built on the WHOs concept and further defined health as a resource for everyday life. a positive concept emphasizing social and personal resources, as well as physical capabilities. In the eyes of our lawmakers, computer software is considered an intangible asset. Under our tax rules today, the cost of all intangible assets acquired by a sales agency as part of the purchase of a business are now amortizable as intangible assets. Previously, those intangible assets were required to be capitalized but could not be claimed as a tax deduction unless they had a readily determinable life. However, when it comes to the costs of developing software (for the sales agencys own use or for sale or lease to others), the agency has a choice: those costs may either be deducted as an immediate expense or amortized over a five-year period (or shorter if it can be established as appropriate). Remember, however, the key is that the costs must be treated consistently. For purchases of computer software, specifically those costs which are not amortizable over 15 years as a Section 197 intangible asset, costs are depreciated using the straight-line method over three years beginning in the month it is placed in service.
This paper, then, addresses educational software and its earliest entries - those made for mainframe computers, and follows its discursive growth to that of the personal computer and its runic lustihood. Those products that exploit the computer chip to its fullest, like interactive, hypermedia authoring software, stand out. But other, more mundane products, like spreadsheets, word processing programs and databases, also have their place in the tableau. The third great revolution - computers and high technology (the first being agriculture and the second the industrial revolution) - has already fundamentally altered life for the better, at least for people in the post-industrialized world. This dramatic shift, as complex and challenging as it is, is really only an elaboration of the Babylonian-developed abacus (The New Encyclopedia Britanica, 1992). The abacus, in use for several millennia, automated arithmetic calculation. That the development of the abacus into its electronic counterpart took one or two millennia points out the sea change of scientific and technical innovation that was needed for such growth.

The increase in construction activity was higher in civil engineering. According to seasonally adjusted data, the value of construction put in place in civil engineering rose substantially for the fourth consecutive quarter (by 9.8% in Q1 alone) and was 67.4% higher than in the same quarter of 2006. This vigorous growth is estimated to reflect the accelerated construction of motorways. Activity in the construction of buildings declined according to seasonally adjusted data. The value of construction put in place in the construction of buildings rose steadily from quarter to quarter last year to reach a record-high level in Q4. The value of construction put in place decreased by 2.0% in the three months to March this year but was still 21.0% higher than in the same period last year. Seasonally adjusted activity declined both in the construction of residential and nonresidential buildings. Otherwise, activity rose considerably in the construction of non-residential buildings while it fell in the construction of residential buildings compared with the same period of 2006. In the latter, it even reached the lowest level in two years, according to seasonally adjusted data. In interpreting the value of residential construction put in place we note that these figures exclude the activity of smaller companies (see the note under the table) in which, in our estimate, the construction of buildings is the main activity. The increase in the number of employees continued in Q1. The number of people employed in the construction sector in 2006 was 7.5% higher than in the year before. In the first quarter of 2007, the number of employees rose by as much as 11.3% over the year before. The number of employees by activity rose particularly in building completion and general construction, similarly as last year. In terms of employee status, sole proprietors and their employees recorded higher growth rates (also see p. 10).
Civil engineering construction continued to increase in the third quarter. The value of construction put in place in this segment of construction was 26.2% higher than a year ago. A year-on-year decrease was recorded only in the construction of residential buildings (see table). In interpreting the value of construction put in place, we note that these figures exclude the activity of smaller firms (see note below table), whose main activity is estimated to be residential construction. According to seasonally adjusted data, activity increased relative to the previous quarter only in civil engineering, whereas activity in residential construction was at its lowest point in the last two and a half years. The growth of employment in the construction sector continued. In the nine months to September, the number of employees surged by 11.0%. As in 2006, the highest increases in employment were recorded in general construction and building completion. The share of firms that were unable to find workers declined in November after Octobers record-high value. According to business trends in construction, 47% of enterprises (employing 52% of workers) reported “shortages of skilled workers” as a limiting factor in November. This figure is smaller than in the previous two months, but still well above the average value of this indicator in the last five years (since data have been available).

Many people elect to become trainers as a way to supplement their income but have no desire to break new ground in health or fitness. Others make it their lifes work and will stop at nothing to see it through. To flirt with the field and portray yourself as a lifer to raise your rates is not cool. * Commit to the hours. Look, garbage men work early in the morning and bartenders work late at night. Trainers usually work when others dont, like many service-industry people. This is something you should know before entering the profession. If thats not okay with you, youll be the trainer who gripes to all his clients about being tired and the hours he keeps. The Capital-Journal First Congregational United Church of Christ, 1701 S.W. Collins, which observes its 150th anniversary this year, will present a five- part poetry series beginning April 10. The poetry workshop will feature a variety of poets who will present their works and also lead discussions and workshops designed to help people in their writing endeavors.
Two European building projects may threaten traditional church architecture as we know it.In the Netherlands, the town of Edam is using its namesake cheese to fund repairs to St. Nicholas Church, a 15th century landmark with beetle and fungus damage. Volunteers are using 10,000 cheese rounds to build a 12-foot replica of the church. “As far as we know no church has ever been built from cheese before,” project spokesperson Nel Eijek told Ecumenical News International. For $11, each sponsor contributes a round of cheese to the project and receives a free visit to the completed Church of Cheese.
Queers outside the church often cite these media portrayals of the church as proof that it is the most homophobic institution in our society, and as support for their view that the sooner queers get out of church, and the sooner it loses its remaining power to shape sexual morality, the better. These critics often exhibit impatience with queer Christians, sometimes going so far as to assert that remaining in the church is a sign of deep-seated internalized homophobia. Sometimes this connection between religious belief and internalized homophobia is accurate. There is more to the story than these media-based views would suggest, however. Indeed, there are distinctively queer voices within the church, and two recent books go far in showing the creativity now energizing queers within Christianity. In the process, they also offer views of Christianity which differ in important - dare we say fundamental - respects from those who oppose a queer presence in the church, as well as those who argue for Christian tolerance of queers. Neither work is without significant limitations, but each offers important resources for queer Christians and those among their allies who are willing to entertain the possibility of a Christianity not only tolerant of the sexually different but also a Christianity changed, indeed made better and more whole, by the contributions of queers. Kathy Rudy, an assistant professor in womens studies at Duke University, offers the more daring book. Her Sex and the Church: Gender, Homosexuality, and the Transformation of Christian Ethics (Boston: Beacon Press, 1999, 240pp., $22.00 [cloth]) offers several arresting arguments which can help the reader think carefully about several kinds of religious orthodoxy, both the Christian right-wing variety and its liberal, tolerance-based relation. The first argument, namely that for the Christian Right gender is the first organizing principle of theology, is not exactly radical, having been articulated by many feminist theologians, but it grounds the entire book. From here, Rudy describes the contemporary rights reliance on the traditional family, its resulting fervent opposition to alternative visions of family, and the deleterious effects of both. She also shows how liberal Christians, and other promoters of tolerance, fail to combat this insidiously genderized theological vision and, indeed, reiterate it themselves.

Understanding that dispute is critical to any of your loved ones living in a nursing home and to you if you someday reside in one. Some health experts and public policy managers claim nursing homes spend less on nurses and aides in order to boost profit margins. Fewer nurses and aides means more dollars flow to the bottom line.
The first step is to hire a design professional who has experience in working with the regulators who have jurisdiction over the facility. The existing codes and regulations written for nursing homes appear to be based on the hospital model, even though — as weve noted — these facilities have quite different functions. These codes and regulations definitely should not be the determining influence on the final layout of a nursing unit. The process for change must begin with dialogue among the regulator, the architect and the owner, and a partnership formed. Our experience has shown that if you start by getting the regulators involved early in the process, they will become an integral part of the team and help obtain the desired goals. The intent is not to try to beat the code, but to develop equivalencies that satisfy regulators safety requirements and administrators operational needs. Working toward the intent rather than the letter of existing codes is challenging, but is worthwhile, because the result can change the look of the nursing station and, at the same time, meet the needs of staff and residents.

Audio/Video Interiors is positioning itself as a smart, souped-up shelter magazine for the nineties consumer.Since launching in 1989, the Woodland Hills, California-based title has seen ad pages climb from 289 as a bimonthly in 1990, according to Publishers Information Bureau figures, to 397 pages as a monthly last year. Through October of this year, the magazines executives note, ad pages are up 12 percent and ad revenues are up 16 percent. (East Coast revenues are up about 26 percent, reflecting the titles growing presence in that region, while revenues for the more mature West Coast market are up about 6 percent.) New advertisers Henredon Furniture, Pennsylvania House Furniture and Jasper Cabinet Co. are just a few of the dozen or so non-endemic players now appearing in the title. Moreover, circulation was up 14.1 percent for the first half of 1993, to 57,765, from 50,628 for the same period of 1992, according to the latest figures from Audit Bureau of Circulations.”The shelter books offer a broader scope and response rate, but the response to AVI has been incredible,” maintains Kathy Oswald, manager of graphic design and photography for Pennsylvania House (where she also oversees advertising).

As portable basketball backstops have become commonplace at all of the pro arenas and a vast majority of college venues, its really no surprise that high schools across the country are opting for a similar main court feel. Plus, portable backstops give schools the flexibility to move the apparatus around and place it in different locations within the confines of a gym. I am talking about the chronic givers–elderly people and those who are doctor dependent. One woman has kept me in eight varieties of home made jam for years. To her I give excess produce from my garden (whether it is suitable for incorporation in jam or not). Patients who insist on bringing chocolate for my children on ever), visit receive some sort of confectionery from them at Christmas. You may argue that by this reciprocity I am perpetuating the situation. I feel it restores a balance. Some patients do not like it, which is fine by me. If they refuse to accept a gift from me how could I possibly take one from them? At this point I have to admit that I was brought up giving presents to patients. I clearly remember, as a child in the 60s, doing the Christmas round with my father, who was also a general practitioner. The back of his car contained a large cardboard box of poinsettias and half a dozen individually wrapped baby bottles of champagne. As darkness fell and Christmas lights came on in windows we would drive from one fusty home to another, greeting impossibly old and decaying and undoubtedly lonely people. Everywhere the welcome was warm; sometimes there were drinks and mince pies, and we collected chocolates and bottles ourselves as the afternoon progressed. These patients had become special to my father over the years by virtue of their age, their disabilities, their social isolation, or just their personalities. Moreover, I suspect that giving as well as receiving at Christmas helped him to maintain a position of strength through the ensuing 12 months of regular visiting, a feature of general practice in those days.

Sir: In his Errors Omissions of 10 September Guy Keleny inveighs against an article about Buenos Aires which referred to leather ware instead of his preferred leather wear. I question his certainty that the author was referring to leather clothing rather than leather goods; Argentina is famous for leather saddles and bridles and, no doubt, leather whips, harnesses, knife sheaths, etc. Ware was clearly being used as in iron ware, software, etc. Soft wear; now theres a thought. LAWYERS who had wanted General Pinochet extradited were still trying early last week to decide what “legal steps” they could take to stop him going to Chile. For some reason I found myself thinking of the sad advertisements one used to see occasionally in the personal columns: “Public school man seeks interesting job, anything legal considered.” But of course I was confusing two different functions of the word legal. Ethical began by meaning “to do with ethics”, and only later came to mean being good. The purist in me still winces when someone says “aesthetic” when they mean “in good taste”. (Aesthetic originally meant “to do with the science of perception”, then “to do with taste”, good, bad or indifferent.) But there was never any need for legal to carry two meanings, because theres a perfectly good alternative that takes half the burden off it: lawful, a nice old word from the late Middle Ages (its parent word, law, appears to be of ancient Scandinavian origin). Everyone understands the difference between “legal business” and the “lawful business” that most of us spend our lives going about. Why couldnt those job-seekers have put “anything lawful considered”? Lawyers use lawful, too; they speak of a “lawful killing”. They dont say “a legal killing” (which, if it meant anything, would presumably refer to their fees).

Criminal cases, where defendants have a right to legal representation, take the lions share of the cash.
